Occupancy Inspection Details

The owners and agents of single-family residences and the individual dwelling units in multi-family structures are required to apply for a Code Compliance Inspection whenever a change of occupancy occurs. A Code Compliance Certificate must be issued before a new occupant may take up residence in the dwelling and before an Occupancy Permit can be issued to the new occupant.

The fee for a residential Code Compliance Inspection is $65. After the Code Compliance Certificate is issued, the prospective new occupant must apply for an Occupancy Permit at the Building Department. The fee for the one-time permit is $15 and it is issued immediately if a current Code Compliance Certificate is on file.

If you are in the ROCK CREEK PUBLIC SEWER DISTRICT and connected to the sewer system inspection is required prior to the sale, change of ownership or a new tenant moves in.

The required inspection is performed by the ROCK CREEK PUBLIC SEWER DISTRICT.

Every owner, lessee, renter, or occupier of any property that is located within the service area of Rock Creek Public Sewer District and is connected to the public sewer system of Rock Creek Public Sewer District shall submit to smoke and /or dye testing or other appropriate test or inspection by Rock Creek Public Sewer District, its employees, agents, and/or designees. The owner, lessee or occupier of the land shall permit said testing upon request. The testing may occur inside and/or outside the structure.

Rock Creek Public Sewer District, its employees, agents, and/or designees, in performing the duties and undertaking the programs identified in this ordinance, shall be empowered to enter upon any private property at all reasonable times, with proper notice to the owner, and in accordance with prevailing law, for the purpose of obtaining information, conducting inspections and/or enforcing this ordinance and shall have only those powers expressly set forth in this ordinance and in other ordinances of the District or provided by law to perform its functions consistent with such ordinances. you are required to obtain a Change of Ownership – Inspection and testing of laterals, wyes, and premises shall be conducted by the District prior to the change of ownership of any property through sale, transfer of title, or foreclosure of the property within the District in accordance with the provisions in ordinance number 2015-4.

The owner of the property or owner’s agent must come into City Hall and request an inspection of the property. The results of the inspection are good for 120 days after the property is inspected, the Building Commissioner will notify the owner in writing of the property’s degree of compliance.

If corrections are necessary, the owner is responsible for making the changes and, when completed, must call the City Hall to set up a re-inspection. (This re-inspection, if done within 120 days, is included in the cost of the original inspection.

When the property complies with Rock Hill’s code, the Occupancy Permit can be issued. The occupant must then come into City Hall and fill out the Occupancy Permit application. After these procedures are completed, the new occupant may move in.

This service is not available to commercial or industrial property. Also, this service is not available to multi-family buildings.

A defective lateral sewer service line is defined as a line that is not functioning property due to
one or more of the following reasons:

  • Collapsed or broken to the extent that adequate flow is not permitted.
  • Service offset of a joint that does not permit adequate flow.
  • Service back fall or belly that does not permit adequate flow.
  • Service blockage that cannot be physically cleaned out.

Tree roots growing through the pipe are not considered to cause the line to be defective. Removal of the roots, which is a routine maintenance issue with older lateral sewer service lines, will allow the line to function. The program will not cover the costs to remove tree roots.

The financial responsibility of the City is limited to excavation, repair or replacement of the lateral line. It will be the responsibility of the property owner to restore the landscaping and ground cover including grass in whatever manner they choose. The City will not be responsible for the restoration of the affected yard to the grass or landscaped surfaces, i.e., bushes, shrubs, trees, and plants. It will be the responsibility of the City to replace sidewalks, driveways and streets, which are removed to accomplish the repair.
